Stillwater Man Charged with Murder, Manslaughter after Downtown Bar Fight

Eric Kaprice Richard, of Stillwater, was charged with unintentional murder and manslaughter stemming from a fight with Adam McCloud at Smalley’s Caribbean Barbeque and Pirate Bar in downtown Stillwater. Richard says he was acting in self-defense.

A 22-year-old Stillwater man was charged by the Washington County Attorney’s Office Friday with homicide in relation to the death of Adam McCloud.

Eric Kaprice Richard, of Stillwater, faces second-degree unintentional murder during the commission of a felony and manslaughter charges stemming from the Sept. 28, fight with McCloud, 29, of Stillwater, at Smalley’s Caribbean Barbeque and Pirate Bar in downtown Stillwater.

The complaint alleges that Richard and McCloud argued over a spilled drink, and that Richard was seen to have repeatedly punched McCloud in the face and head, causing him to fall and strike his head on the ground.

Richard told police he was acting in self-defense after being pushed by McCloud several times.

His bail was set at $200,000.

According to the complaint:

Video surveillance shows the two men were on the bar's dance floor when McCloud knocked a drink out of Richard’s hand.

The two men had a conversation, and then left the dance floor—when they came back on the dance floor Richard had another drink in his hand.

After that, the two men appeared to have been “interacting in a friendly manner,” dancing together and talking with others on the dance floor, the complaint states.

But shortly after the lights went on at bar close, McCloud was seen on video making a pushing motion, a man then grabbed McCloud and walked him away from the confrontation when Richard “rapidly came into camera range” and landed at least two punches, knocking McCloud to the ground.

The man who was seen on video walking McCloud away reportedly told police an argument took place after McCloud agreed to replace the drink, but refused to pay for it.

The witness told police the two men had words; McCloud pushed Richard, and Richard responded in self-defense by punching McCloud.

Richard told police that he and McCloud had gotten into an argument—and after McCloud pushed him at least four times, he felt he was being assaulted and punched McCloud in self-defense.

Richard told police McCloud then fell to the ground. He was then removed from the bar.

As a result of the fight, McCloud suffered several skull fractures and intracranial bleeding causing respiratory failure and, ultimately, his death on Oct. 4.

“That a death was caused over such a trivial thing as this is so tragic as to be beyond belief,” Orput said. “Our thoughts and prayers go out to this young victim’s family with the message that our office will do all that we can to bring justice to them.”

Reading the details, in the report, really brings this to life. Which just proves how avoidable it was. I truly hope the community rallies together to end this senseless violence. Thoughts and prayers to all involved.

Adam McCloud, I remember Adam when him was a teenager. Adam was my daughter's
first boyfriend. He was a nice person. I was sorry to hear what happen to him. My heart goes out to his family. I think if their was not alcohol involved that would had never happened. My prayers go out to adams family and this young man who is now facing prison. Ann Christos

I think it is also a lesson that you shouldn't get so worked up over a drink. It is sad that someone died but both men's lives were ruined and both were at fault. None of it was neccessary.

He ask if he can buy him a drink and then the black dude hit Adam he was my home boy so im sorry that you lost him me and him where good friends.

A friend of my dads that was there at the seen said McCloud was going around "sack tapping" people including him and when McCloud "sack tapped" Richards he re-acted in self-defense. I don't blame Richards for the way he acted that is sexual harassment.

So the proper way to respond to sack tapping is to murder the person?? My coworker was there and there was no sack tapping. Interesting thing to make up though. Tell your friends dad that he's got a strange imagination. I wouldn't want to play tag with you for fear that you would feel justified in killing me for assault. It's too bad Eric Richards had been in multiple fights in stillwater in the 2 weeks prior to this incident. The self defense lie may have worked.

Matt H., I'm not sure what you mean. I deleted my comment because Anonymous did not respond. I didn't say anything about the men vs women fighting, I only asked if men actually did this to each other....it was the first time I heard this term and I thought the entire concept was stupid. At the same time, I made a point of saying that I was not commenting about this incident.

Matt punching someone twice after you had already tried to walk away and then were asulted a second time is not murder. Hindsight is 20/20.
Anyone can die from a single punch. Most people don't, that's why it was a reasonable form of self defense. It's sad he died, but that was clearly not the reason he defended himself by punching McCloud.

Eric Richards is my younger cousin and I personally know that he feels horrible about the outcome of this confrontation.It was never his intent to cause any permanent damage to the victim but felt he was being assaulted and believed he was defending himself.Fighting is never really the answer and this is definitely a tragedy.But speaking on my cousins behalf,it was a fight and there was no way to predict that this incident would result in the death of Adam McCloud.Our prayers go out to the families involved.
