Mediation and Divorce

Sheila-Marie Untiedt of Clean Slate Mediation discusses divorce and mediation.

Mediation is often the best path to resolve conflict because the
process is driven by the actual participants who most understand the issues and the challenges. Family law and marriage dissolution are the mediation applications most familiar to most people. It seems everyone has a sibling or a coworker that has used mediation in a divorce.

Mediation can occur before a divorce is filed with the court and even before either party has an attorney. It can occur once one party has filed for divorce; it can be ordered by the court for the spouses to attempt to settle their issues through mediation. The court system frankly does not have time or resources to create the divorce settlements. Mediation often occurs post divorce decree to fine tune points of the divorce settlement such as parenting schedules, one spouse has a new job on the other side of the metro and how will that all work out, college decisions and financing, etc.

Mediation is a wonderful tool that creates collaboration, trust, a positive framework for interact and almost always is a much less expensive process than traditional court and attorney divorces.
